CLARIFICATION TEXT FOR CUSTOMERS OF IDEA TECHNOLOGY SOLUTIONS

Idea Teknoloji Cozumleri Bilgisayar Sanayi ve Ticaret A.S. ("Idea Teknoloji" or "Company"), as the data controller, we process the personal data of our customers in line with the fulfillment of business processes within the scope of the Personal Data Protection Law No. 6698 ("KVKK" or "Law") and the relevant legislation, and at the same time, we make every effort to protect the data we process by taking the technical and administrative measures specified in the KVKK, the secondary legislation enacted under the KVKK, the binding decisions of the Personal Data Protection Board and other legislation.

With this text, as the data controller, we fulfill the disclosure obligation specified in Article 10 of the KVKK and thus aim to inform you, our customers, in detail about the processing processes of your personal data.

1. METHOD OF COLLECTING YOUR PERSONAL DATA

We, as the data controller, collect the personal data of our customers in whole or in part by automated means or, provided that it is part of a data recording system, by non-automated means; 

• Via email, telephone, contracts and declared documents, 
• Complaints and requests submitted to Idea Teknoloji by phone, e-mail or other means, 
• Printed forms and necessary information and documents to be filled in due to reasons arising from legal legislation and legal obligations of Idea Teknoloji, 
• Company programs, network and electronic mail services provided by Information Technologies, 
• Use of video chat applications connected to an email account during online meetings and recording of educational content, through the agency.

2. YOUR PROCESSED PERSONAL DATA, THE PURPOSE OF PROCESSING SUCH DATA AND THE LEGAL REASON FOR THEIR COLLECTION

Personal data refers to any information relating to an identified or identifiable natural person. For you, our customers, personal data such as name, surname, T.R. identification number / Tax Number are processed within the scope of the following business processes of Idea Teknoloji.

The personal data of Idea Teknoloji customers are classified according to the data categories as specified in the table below:

• Execution of Finance and Accounting Affairs,
• Execution of Logistics Activities,
• Execution of Activities in Compliance with the Legislation,
• Execution of Contract Processes,
• Providing Information to Authorized Persons, Institutions and Organizations,
• Execution of Reporting and Information Processes,
• Follow-up and Execution of Legal Affairs,

As a data controller, in order to ensure the security of our operations, it is processed for the purposes of planning the internal organizations of the Company, and the personal data of its customers are processed for the purposes specified in Articles 5 and 6 of the KVKK. The existence of the explicit consent of the person concerned; personal data processing is clearly stipulated in the laws; personal data processing is mandatory for Idea Teknoloji to fulfill its legal obligation; it is necessary to process the personal data of the parties due to the fact that it is directly related to the establishment and fulfillment of the business contract; personal data processing is mandatory for the establishment, use or protection of a right; provided that it does not harm the fundamental rights and freedoms of the person concerned, it is collected by Idea Teknoloji based on the legal reasons that personal data processing is mandatory for the legitimate interests of Idea Teknoloji.

3. PERSONS TO WHOM YOUR PERSONAL DATA ARE TRANSFERRED AND PURPOSE OF TRANSFER

Your personal data;

For the purposes of the administration of the Company, the conduct of business, the implementation of Company policies, in particular;

Lawyers, auditors, tax consultants and other third parties from whom we receive consultancy services in order to carry out our business processes in accordance with the law and our other legitimate interests and to exercise our right of defense in a possible judicial process,

In order for us to fulfill our legal obligations; to regulatory and supervisory institutions and relevant official institutions such as courts and enforcement offices and other public institutions or organizations authorized to request your personal data, provided that it is in accordance with the law and procedure,

In order for us to fulfill the obligations arising from the employment contract concluded with you or to carry out audit activities; to our business partners,

Due to the fact that the Sharepoint, Service Desk applications used and the software, cloud system, e-mail infrastructure we use are located abroad, the Company's administration, business processes and implementation of Company policies are carried out abroad,

Since the servers and databases of the "Microsoft Teams" application used in online interviews are located abroad, it will be transferred abroad in order to conduct online interviews remotely.

The infrastructure systems of the servers where we provide our Electronic Financial Services are located within the borders of Turkey and your personal data regarding the services provided within this scope are not transferred abroad.

4. YOUR RIGHTS REGARDING YOUR PERSONAL DATA

Regarding your personal data;

a) Learn whether your personal data is being processed,

b) Request information if your personal data has been processed,

c) To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,

d) To know the third parties to whom your personal data is transferred domestically or abroad,

e) To request correction of your personal data in case of incomplete or incorrect processing,

f) To request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the KVKK,

g) To request notification of the transactions made pursuant to subparagraphs (d) and (e) to third parties to whom personal data are transferred,

h) Object to the occurrence of a result against you by analyzing your processed data exclusively through automated systems,

i) If you suffer damage due to unlawful processing of your personal data, you have the right to demand compensation for your damage.

Within the scope of your specified rights, you may submit your requests via registered letter with return receipt requested, in person, in writing through a notary public, registered electronic mail (KEP) address, secure electronic signature, mobile signature or by using your e-mail address if you have an e-mail address previously notified to us and registered in our system, or by contacting us through a software or application developed for the purpose of application. Your requests will be finalized free of charge within thirty days at the latest after they are delivered to us through the specified means.

As stated in the "Communiqué on the Procedures and Principles of Application to the Data Controller" published by the Personal Data Protection Authority in the Official Gazette dated March 10, 2018 and numbered 30356, your requests in your application will be answered free of charge; however, if the response to your application is given in writing, you may be charged 1 TL for each page over the first ten pages and a fee not exceeding the cost of the recording medium if the response is given in a recording medium such as CD, flash memory. The fee will be refunded to you if your application is due to our error.

Your application will be answered in accordance with the relevant provisions stipulated in the KVKK, and Idea Teknoloji may request some verifying information from you in order to confirm that the applicant is the right person; this information will only be requested in order to determine who the real data owner is and to share the results of the application with the right person.
